These terms govern your use of HostUnique websites and the hosting, domain, and related services we provide.

1. Agreement to terms
By accessing hostunique.co.za, creating an account, or purchasing services from HostUnique ("we", "us", "our"), you agree to these Terms of Service. If you do not agree, please do not use our website or services.
These terms should be read together with our Privacy Policy and any service-specific agreements or order confirmations provided at the time of purchase.
2. Services
HostUnique provides web hosting, domain registration, email hosting, hospitality website packages, and related digital services to clients in South Africa and elsewhere. Service features, resource limits, and pricing are described on our website and in your order confirmation. We may modify, suspend, or discontinue features with reasonable notice where practicable, except where immediate action is required for security or legal compliance.
3. Account registration and billing
Orders, invoicing, renewals, and account management are handled through our WHMCS client area (client area). You agree to provide accurate registration and billing information and to keep it up to date.
- Fees are charged in South African Rand (ZAR) unless otherwise stated.
- Recurring services renew automatically according to the billing cycle selected at checkout, unless cancelled in accordance with these terms.
- Failure to pay invoices by the due date may result in suspension or termination of services after reasonable notice.
- Domain registrations and certain third-party services may be non-refundable once provisioned, subject to registry rules.
- Refunds, where applicable, are handled according to our published refund policy or as required by applicable consumer protection law.
4. Acceptable use
You must not use our services to:
- Violate any applicable law or regulation in South Africa or your jurisdiction.
- Send unsolicited bulk email (spam), phishing messages, or malware.
- Host, distribute, or link to illegal content, including content that infringes intellectual property rights.
- Attempt unauthorised access to our systems, other accounts, or third-party networks.
- Run resource-intensive processes that negatively affect server stability or other clients, unless expressly permitted by your plan.
- Engage in fraud, harassment, or activity that harms HostUnique, our infrastructure, or other users.
We reserve the right to investigate suspected violations and to suspend or terminate services without refund where necessary to protect our network, clients, or legal obligations. We may report unlawful activity to relevant authorities.
5. Your content and data
You retain ownership of content you upload or host using our services. You grant us a limited licence to store, transmit, and process that content solely to provide and support the services. You are responsible for maintaining your own backups of critical data unless a specific backup service is included in your plan.
While we implement reasonable backup and recovery measures, we do not guarantee that backups will be available or restorable in all circumstances. You should maintain independent copies of important files and databases.
6. Domain names
Domain registration and transfer services are subject to the policies of the relevant registry and registrar. You are responsible for ensuring that your domain registration details are accurate and that your use of the domain complies with applicable rules. We are not liable for loss of a domain due to expired registration, incorrect WHOIS information, registry policy changes, or disputes between registrants.
7. Service availability and support
We aim to provide reliable hosting infrastructure and responsive support during business hours. However, services are provided on an "as is" and "as available" basis. Scheduled maintenance, third-party outages, force majeure events, and factors outside our reasonable control may affect availability. We do not guarantee uninterrupted or error-free service unless a specific service level agreement (SLA) has been agreed in writing.
8. Suspension and termination
You may cancel recurring services through the WHMCS client area subject to any minimum term or notice requirements stated at purchase. We may suspend or terminate services immediately if you breach these terms, fail to pay amounts due, or if continued provision poses a security or legal risk.
Upon termination, we may delete hosted data after a reasonable grace period. It is your responsibility to export data before cancellation or expiry.
9. Limitation of liability
To the fullest extent permitted by applicable law, HostUnique shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunity, arising from your use of our website or services.
Our total liability for any claim relating to a specific service shall not exceed the fees paid by you for that service during the twelve (12) months preceding the event giving rise to the claim, except where liability cannot be excluded under South African consumer protection or other mandatory law.
10. Indemnity
You agree to indemnify and hold HostUnique harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the services, your content, your breach of these terms, or your violation of any third-party rights or applicable law.
11. Intellectual property
The HostUnique name, logo, website content, and proprietary materials are owned by or licensed to us and may not be copied or used without permission. Third-party trademarks and software referenced on our site remain the property of their respective owners.
12. Governing law
These Terms of Service are governed by the laws of the Republic of South Africa. Any dispute arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of South Africa, without prejudice to your rights under applicable consumer protection legislation.
13. Changes to these terms
We may update these Terms of Service from time to time. The "Last updated" date at the top of this page shows when they were last revised. Continued use of our website or services after changes take effect constitutes acceptance of the updated terms. Material changes affecting active services will be communicated through reasonable channels, such as email or client area notice.
